Ticket for speed contest….HELP
Question:
This is a no brainier: First, plead Not Guilty. Call ahead to see if you do this in person will you have a chance to talk to the prosecuting attorney. Some police prosecute their own tickets. Second, find out from the clerk of the court when you will be given an opportunity to talk with the prosecuting attorney or the charging officer. Third, just prior to trial cop a deal. In your case I recommend strongly that you hire an attorney with experience in this field and a good reputation. With luck you can enter a plea to an non-speeding violation, thus saving your points and your insurance costs, which can add up over the next few years.

Oh and there is no way a cop can be certified to 1mph. 3mph is the standard.

Ok, here is my story, I dont know where you live, but in GA. they cant get you at all on by sight, I have never even heard of this, however im sure it may be done. In GA, anything over 24 over and under 21 years old means you lose liscense for 6months to 1 year. I agree with finding a good lawyer. If you are in school and have a job take a payslip and point this out, it helped me alot (64 in a 35 -> restricted liscense). If you cannot afford a lawyer, goto the local library, and find the law section. Ask the girl behind the desk where the law books are, they may even help you find it in the books, they helped me. Find anything you can in the books on the speed checked by sight thing. Also make sure you look up previous cases if you can. Call everyone and try to cop a plea. Racing here is a HEAVY violation which causes revocation of the liscense, however doing twice the limit is supposedly a straight to jail type of thing. Ummm…. sounds like that cop is BS’ing you. They will say anything to just get you to think that you have no chance of fighting the ticket….. their hope is that you will just plead guilty and not ask questions. They know that most traffic tickets are thrown out if you have a lawyer fight it. ‘State certified to 1MPH by sight’, even if this is true… which I doubt… I’m sure it won’t hold up in court. You probably will need a lawyer to contest it though. I have talked to a couple of cops about that. In Wisconsin, the state troopers are certified and can be admissable in court. As for the speed contest, I don’t know. Hope that helps.
